Terms and Conditions for Use of YourBest Hub

Introduction

These terms and conditions (the "Terms") apply to your access and use of the YourBest Hub website, services, and all associated content (collectively referred to as the "Services"). By creating an account on YourBest Hub, you agree to be bound by these Terms.

Use of Services

You may use the Services only for lawful purposes and in accordance with these Terms. YourBest Hub reserves the right to restrict or terminate your access to the Services at any time for any reason, including, but not limited to, violation of these Terms.

Account Creation and Security

When you create an account on YourBest Hub, you are responsible for maintaining the confidentiality of your login information and are fully responsible for all activities that occur under your account. You agree to immediately notify YourBest Hub of any unauthorized use of your account or any other breach of security.

User Content

The Services may allow you to upload, post, or otherwise transmit content, including but not limited to text, photos, and videos (collectively, "User Content"). You retain all rights to your User Content and are solely responsible for its accuracy and legality. By uploading User Content, you grant YourBest Hub a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, and display your User Content while your account is active and in good standing. Upon termination or deactivation of your account, YourBest Hub will retain a limited license to make your User Content available to those who have already purchased it, but YourBest Hub will not have the right to sell or use it for any other purposes beyond that.

Intellectual Property

The Services, including all software, content, and design elements, are protected by intellectual property laws, including copyright and trademark laws. YourBest Hub and its licensors own all right, title, and interest in and to the Services. You may not use the Services or any content contained in the Services in any manner that infringes the rights of YourBest Hub or its licensors.

Privacy and Security

YourBest Hub is committed to ensuring the privacy and security of its members' personal and health information. In accordance with the Personal Health Information Protection Act (PHIPA), YourBest Hub has implemented appropriate technical, physical, and administrative safeguards to protect the confidentiality, security, and integrity of all personal and health information collected, stored, and processed through our platform, including the client management portion of the Services. YourBest Hub will only collect, use, and disclose personal and health information in accordance with PHIPA and as necessary for the provision of the Services.

Fees

Creating an account and setting up a profile, including booking services and uploading content, is free. Accessing our community and free resource and knowledge base is also free. However, if you choose to publish your profile, a fee of $79 CAD per month plus applicable taxes will apply. YourBest Hub does not take any commission or additional fees off of client bookings. Additional fees may be incurred if you sell paid content, workshops, or courses through the site. For hosting the content, driving traffic to the site to help with marketing, and maintaining the content on the site for up to 1 year, YourBest Hub will take a 30% commission. There may also be additional fees associated with joining our academy programs or purchasing additional services from us. YourBest Hub reserves the right to modify its fees for the Services at any time, and such changes will be effective immediately upon posting on the YourBest Hub website. If you do not agree to the new fees, you may cancel your account before the changes take effect. By using the Services, you agree to pay any applicable fees as described on the YourBest Hub website. YourBest Hub may use a third-party payment processor to process payments, and you agree to be bound by the terms and conditions of the third-party payment processor in addition to these Terms.

Disclaimer of Warranty

YourBest Hub provides the Services "as is" and makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the content contained therein. YourBest Hub disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

In no event will YourBest Hub be liable for any damages, including without limitation, direct, indirect, incidental, special, or consequential damages, arising out of the use of or inability to use the Services, even if YourBest Hub has been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold YourBest Hub and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User Content submitted by you, your use of the Services, your connection to the Services, your violation of the Terms, or your violation of any rights of another.

Termination

YourBest Hub may terminate this agreement and your use of the Services at any time, with or without notice and with or without cause. Upon termination, you must immediately cease all use of the Services.Changes to Terms.

Changes to Terms

YourBest Hub reserves the right to modify these Terms at any time without prior notice. Your continued use of the Services following any changes to these Terms constitutes your acceptance of the new terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without giving effect to any principles of conflicts of law.

General Terms

These Terms constitute the entire agreement between you and YourBest Hub regarding your use of the Services. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. YourBest Hub's failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. In the event of any conflict between these Terms and any agreement you have with YourBest Hub, the terms of such agreement will control. These Terms are binding on you and YourBest Hub's successors and assigns.

Planners Program Membership Agreement

Payment

You are entitled to a one-time 3-day free trial of the Planners Program. If you choose to remain enrolled beyond the 3rd day from joining, you will be enrolled in an ongoing monthly membership. On the 3rd day beyond enrollment, your credit card will be charged $149 CAD + applicable taxes, and every month thereafter until you cancel. You are required to remain in the program for a minimum of 3 billing cycles.

If you complete the program before your 3rd billing cycle, you may upgrade to the Growers program at any time without fulfilling the minimum commitment in the Planners program.

As a bonus, while you are enrolled in the Planners Program, you will receive a free membership on our YourBest Hub. Additionally, upon completion of the program, you will be eligible for a $30 per month discount on YourBest Hub for the next 6 months.

Intellectual Property Rights

The contents of this program are for the personal use of currently enrolled students only, and may not be shared with anyone outside of this program, either for free or for profit, without permission. All intellectual property rights associated with the program are owned by YourBest and/or its affiliates. Any unauthorized use or reproduction of the program's contents is strictly prohibited and may result in legal action.

Code of Conduct

YourBest is committed to creating a respectful, safe environment free of discrimination, harassment, and offensive/abusive behavior. All members and coaches are expected to show respect at all times, through written, verbal and visual interactions with one another. All information shared within the program, including between members, should be treated as confidential and is not to be shared outside of the program, except with explicit consent. Failure to follow this code of conduct will result in either a warning or permanent removal from the program, without a refund.

Cancellations/Refunds

We are committed to providing high-quality service and ensuring your satisfaction with the program. However, if for any reason you need to cancel your membership, you may do so after the first 3 billing cycles by logging into your YourBest account and cancelling your membership. Your cancellation will be effective at the end of your current billing cycle.

Please note that we are not able to offer any refunds for any reason, including withdrawals, non-participation, or extended time away. You are not able to pause your membership. After the first 3 billing cycles, you can cancel at any time and rejoin later under the same terms, unless you upgrade to the Growers Program.

YourBest Hub Access and Discount

While you are enrolled in the Planners Program, you are eligible for a complimentary Premium YourBest Hub membership . This membership includes access to all YourBest Hub content and resources. Additionally, following completion of the Planners Program, you are eligible for a year of free access to a Premium YourBest Hub Plan.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of Canada and the Province of British Columbia. The parties irrevocably submit to the exclusive jurisdiction of the courts of British Columbia for the purpose of any suit, action or other proceeding arising out of this agreement.

By enrolling in the Planners Program, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this agreement.

Growers Program Membership Agreement

Payment

You are entitled to a one-time 3-day free trial of the Growers Program. If you choose to remain enrolled beyond the 3rd day from joining, you will be enrolled in an ongoing monthly membership. On the 3rd day beyond enrollment, your credit card will be charged $249 CAD + applicable taxes, and every month thereafter until you cancel. You are required to remain in the program for a minimum of 3 billing cycles. If you complete the program before your 3rd billing cycle, you may upgrade to the Expanders program at any time without fulfilling the minimum commitment in the Growers program.

All information shared within the program, including between members, should be treated as confidential and is not to be shared outside of the program. Failure to follow this code of conduct will result in either a warning or permanent removal from the program, without a refund.

Cancellations/Refunds

We are not able to offer any refunds or cancellations for any reason, including withdrawals, non-participation, or extended time away.

Your monthly autopay does not automatically end after 3 cycles and we cannot cancel your membership for you. To cancel your membership at any point after the 3rd billing cycle, you must log into your account and cancel your membership. When you cancel, you will always have access until the end of your billing cycle, which is based on the date that you joined the program. You are not able to pause your membership. After the first 3 billing cycles you can cancel at any time and rejoin later under the same terms, unless you upgrade to the Expanders Program.

YourBest Hub Access and Discount

While you are enrolled in the Growers Program, you are eligible for a complimentary Premium YourBest Hub membership. This membership includes access to all YourBest Hub content and resources. Additionally, following completion of the Growers Program, you are eligible for a $30 CAD monthly discount on the Premium YourBest Hub Plan for 6 months. This discount will be automatically applied to your YourBest Hub membership once you complete the Growers Program.

By enrolling in the Growers Program, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this agreement.

Expanders Program Membership Agreement

Payment

The Expanders Program is a 12-month program. By enrolling in the Expanders Program, you have chosen one of two payment options:

A. $750 CAD + applicable taxes per month for a minimum of 12 months, and every month thereafter that you choose to remain enrolled in the program. If you cancel your membership before the twelfth billing cycle, your card will still be automatically charged up to 12 billing cycles.

B. $8000 CAD + applicable taxes per year, paid up front, and on an annual basis each year thereafter that you choose to remain enrolled in the program. Your payment is a monthly or annual autopay that will renew automatically unless canceled by you.

We are not able to offer any refunds or cancellations for any reason, including withdrawals, non-participation, or extended time away.

Your monthly autopay does not automatically end after 12 monthly cycles, or 1 annual cycle, and we cannot cancel your membership for you. When you cancel, you will always have access until the end of your billing cycle, which is based on the date that you joined the program.

You are not able to pause your membership. After the first 12 billing cycles on monthly autopay, or 1st billing cycle on annual autopay, you can cancel at any time and rejoin later under the same terms.

YourBest Hub Access and Discount

As a member of the Expanders Program, you are eligible for a complimentary Premium YourBest Hub membership for the duration of your time in the Expanders Program. This membership includes access to all YourBest Hub content and resources. Additionally, following completion of the Expanders Program, you are eligible for a $30 CAD monthly discount on the Premium YourBest Hub Plan for 6 months. This discount will be automatically applied to your YourBest Hub membership once you complete the Expanders Program.

Governing Law

By enrolling in the Expanders Program, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this agreement.
